New Balance Compression Trade Promotion


Conditions of entry


  1. Information regarding prizes and how to enter forms part of these conditions.  By entering, entrants accept these conditions.

  2. The promotion is only open to Australian residents who are staff members (excluding owners, principals and store managers) of a Rebel Group Pty Ltd business operating in Australia for the duration of the Promotion Period (Participating Business) who have (a) registered with the Promoter to enter and participate in this promotion and (b) whose registration information has been processed by the Promoter. Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter are not eligible to enter.

  3. The promotion begins at 9.00am (local time) on 16/08/10 and closes at 5.30pm (local time) on 26/09/10 (Promotion Period).

  4. To enter, entrants must, during the Promotion Period:

    1. sell, on behalf of a Participating Business, any pair of 2010 New Balance running shoes or any item from the 2010 New Balance Compression Apparel range; and

    2. process the sale through the Rebel Sales/POS system (Eligible Sale).

  5. At the end of the Promotion Period, the principal/owner/store manager of each Rebel Group Pty Ltd Participating Business must send an email to the Promoter (to the email address provided by the Promoter) enclosing a Microsoft Excel spreadsheet listing the Participating Business’ name, all of the Eligible Sales made by that Participating Business during the Promotion Period, the department where each Eligible Sale was made, the entrant who made each Eligible Sale and any other information requested by the Promoter.  This email must be received by the Promoter no later than close of business on 08/10/10.  Once this email is received by the Promoter, each entrant listed on the spreadsheet will receive one entry into the promotion for each Eligible Sale they made.  Entries are deemed to be received at the time the email is received by the Promoter.

  6. Incentives will only be paid on Q3 2010 running shoes and/or 2010 Compression Apparel range (i.e. sales of previous quarters colourways will not be eligible).  The Promoter reserves the right to verify each Eligible Sale in its absolute discretion.  Eligible Sales made outside the Promotion Period are not valid.

  7. Entrants may enter as many times as they wish, provided that each entry is based on a separate Eligible Sale.

  8. At the end of the Promotion Period, the Promoter will provide each entrant with a Visa debit card with a credited amount equalling $10 for each valid entry, based on each Eligible Sale as set out in the Participating Business’ spreadsheet received by the Promoter via email from the principal/owner/store manager of the Participating Business (e.g. if an entrant makes 10 verified Eligible Sales, they will receive a $100 Visa debit card).  Visa debit cards are subject to conditions of use as imposed by the prize supplier.

  9. The Promoter is not liable for any late, lost, incomplete, misdirected, incorrectly submitted, delayed, illegible or corrupted entries, claims or correspondence due to error, omission, alteration, tampering, theft, communications failure, destruction or otherwise, including failure of an email from a principal/owner/store manager to be sent to or received by the Promoter.  The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise.  The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.

  10. Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter’s discretion.  This promotion is based on skill; chance plays no part in determining the recipients of prizes.  The judges' decisions are final and no correspondence will be entered into.

  11. The prize recipients must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the receiving of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.

  12. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

  13. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.

  14. Prize recipients will be notified in writing.  The prizes will be distributed to each Participating Business for distribution to entrants by that Participating Business’ owner/principal/store manager.

  15. The Promoter may require prize recipients to provide proof of identity and proof of employment at a Participating Business.  Identification considered suitable for verification is at the Promoter’s discretion.

  16. Entrants must remain employed at a Participating Business for the duration of the Promotion Period in order to be eligible.  If an entrant is deemed not to comply with these conditions of entry, all entries received in respect of that entrant will be discarded.

  17. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this promotion by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the promotion or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person.

  18. Prizes are not transferable or exchangeable.  Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.

  19. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries.

  20. The Promoter and its associated agencies are not liable for any tax implications arising from the receipt of prizes, including fringe benefits tax.  Independent financial advice should be sought.  Where the operation of this promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

  21. All entries will be the property of the Promoter.  The information entrants and Participating Businesses provide will be used by the Promoter for the purpose of conducting this promotion. The Promoter may disclose such information to its contractors and agents to assist in conducting this promotion or communicating with entrants and Participating Businesses.  The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.  Individuals can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
